ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos. 1 and 2, in Crime No.98 of 2015 on the file of the respondent police, were arrested and remanded to judicial custody on 28.10.2015 for the alleged offences punishable under Section 436,429,307 of IPC r/w. 3
(1) PPDL Act and hence, seek bail.
2. The case of the prosecution is that due to previous motive the petitioners were set fire to goats shed and attacked the de facto complainant with wooden-log and caused injury to him. Further, the petitioners have also threatened the de facto complainant with dire consequences.
3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any such offence as alleged by the prosecution. Since the petitioners are in judicial custody from 28.10.2015, the learned counsel pray for granting of bail to the petitioners.
4. The learned Government Advocate (Crl. Side) submitted that the injured has already been discharged from the hospital.
5. Considering the facts and circumstances of the case and also considering the fact that the injured has already been discharged from the hospital, this Court is inclined to grant bail to the https://hcservices.ecourts.gov.in/hcservices/
petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Keeranur and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m. until further orders.
