Mr.E.Antony Sahaya Prabahar Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- This petition is filed to enlarge the petitioner on bail in the event of his arrest by the respondent Police on the strength of the NBW issued in C.C.No.315 of 2023 in Crime No.220 of 2021 on the file of the learned Principal Special Court for NDPS Act Cases, Madurai.

ORDER : The Court made the following order :- The petitioner/A4, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w 20(b) (ii)(B) and 25 of NDPS Act, in Crime No.220 of 2021 on the file of the respondent police, which was taken on file as C.C.No.315 of 2023, seeks anticipatory bail.

2.The learned counsel appearing for the petitioners submitted that based on the confession statement of the other accused, the petitioner has been arrayed as accused.

Thereafter, the respondent Police filed absconding charge sheet before the Concerned Court. Hence, the concerned Court issued NBW as against the petitioner. Hence, he seeks anticipatory bail to the petitioner.

3.The learned Government Advocate (Crl. Side) appearing for the respondent Police submitted the respondent Police filed absconding charge sheet before the Concerned Court and NBW was issued as against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioner.

4.After hearing the arguments made on either side, the petitioner is directed to surrender before the learned Principal Special Court for NDPS Act Cases, Madurai, on the next hearing and to file a petition under Section 70(2) of Cr.P.C., to recall NBW already issued against him. On filing of such petition, the concerned learned sessions Judge is directed to consider the same on its own merits and in accordance with law.

5.With the above directions, this Criminal Original Petitions stands disposed of.
