O R D E R

This Writ Petition has been filed seeking for a Writ of Mandamus to direct the respondents to disburse the Medical Reimbursement, on account of the treatment undergone by the writ petitioner's wife, on the basis of the representation dated 16.12.2024.

2.The case of the petitioner is that his wife took medical treatment at Dr.Rela Institute and Medical Centre Hospital, Chennai and spent a sum of Rs.9,77,577/- towards the medical expenses. The Insurance Company sanctioned only a sum of Rs.2,21,832/-. Aggrieved by the same, the petitioner filed a writ petition in W.P(MD)No.10951 of 2024. The said writ petition was disposed of by order dated 30.04.2024, granting liberty to the petitioner to approach the District Level Empowered Committee. In compliance of the same, the petitioner made a claim before the District Level Empowered Committee i.e., the third respondent herein on 18.11.2024. Due to inaction of the third respondent in considering the claim of the petitioner made on 18.11.2024, he filed the present writ petition.

3.The learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that the District Level Empowered Committee has considered the claim of the petitioner on 18.11.2024 and accordingly, they recommended the claim of the petitioner to the fourth respondent for settlement, vide letter, dated 20.11.2024 and the issue is

pending at present with the fourth respondent. 4.Facts are not disputed in this case. Admittedly, the treatment of the wife of the petitioner is covered under the New Health Insurance Scheme, 2021. The competent District Level Empowered Committee constituted by the State Government has considered the claim of the petitioner and sent its recommendation to the fourth respondent vide letter dated 20.11.2024. Now, it is the duty of the fourth respondent to settle the claim.

5.Considering the facts and circumstances of the case, it is reasonable and appropriate to dispose of this writ petition without going into further merits of the case with a direction to the fourth respondent to settle the claim of the petitioner as per letter dated 20.11.2024 of the District Level Empowered Committee within a stipulated time. 6.Accordingly, this writ petition is disposed of with a direction to the fourth respondent to settle the claim of the petitioner as per letter dated 20.11.2024 of the third respondent, within a period of two weeks,

from the date of receipt of a copy of this order.There shall be no order as to costs.
