ORDER

The petitioner has filed the present petition under Section 482 of the Code of Criminal Procedure seeking for a direction to the first respondent not to harass the petitioner and his family members under the guise of an enquiry.

2.Mr.R.Erottuchamy, learned Government Advocate (Criminal side), who accepts notice on behalf of the first respondent, on instructions, would contend that the second respondent lodged a complaint against the present petitioner before the Inspector of Police, Manamadurai Town Police Station and the same was registered in CSR.No.64 of 2021 and is posted for enquiry. 3.A perusal of a copy of the complaint shows that the second respondent lent a sum of Rs.4,00,000/- to the present petitioner and also gave three sovereigns of jewels and that the petitioner https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.2690 of 2021 did not return the same to the second respondent. The matter in dispute between the parties seems to be purely a money transaction and the police cannot interfere in such dispute between the petitioner and the third respondent. Therefore, the present Criminal Original Petition is disposed of with a direction to the first respondent not to interfere with the dispute between the petitioner and the second respondent and the parties are at liberty to approach a civil Court to resolve their dispute.
