ORDER

This Writ Petition has been filed for issuance of a Writ of Mandamus, directing the first respondent to conclude enquiry in Na.Ka.No. 876091/2023/D6 dated 28.04.2023 within the time stipulated by this Court.

2. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that after purchase of the property, the petitioner has applied for change of patta in his name to the third respondent. The land has been classified as ground rent natham during UDR settlement and hence, the petitioner approached the first respondent to rectify the error, which was also taken on file by him in Na.Ka.No.876091/2023/D6, which is still pending. Hence, the petitioner came before this Court with the aforesaid prayer.

4. The learned Special Government Pleader appearing for the respondents has produced the proceedings of the third respondent in Na.Ka.A2/7788/2019, dated 13.02.2024, in which it has been recommended by 2/4

considering the welfare of the school students that patta can be issued on condition that it can be used only as school playground. He further submits that the enquiry will be completed within the time frame fixed by this Court.

Considering the facts and circumstances of this case, this Court, without expressing any opinion on the merits of the matter, directs the first respondent to complete the enquiry pending in Na.Ka.No.876091/2023/D6 by considering the proceedings of the third respondent, dated 13.02.2024, after affording an opportunity of hearing to the petitioner and any other necessary party, whom the respondents deem fit to put on notice, within a period of sixteen (16) weeks from the date of receipt of a copy of this order.

6. With the above direction, the Writ Petition stands disposed of. No costs.
