Respondent PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure to direct the I Additional Sessions Judge, Tirunelveli to expedite the trial in S.C.No.386 of 2004 within a time frame fixed by this Court.

O R D E R

The petitioner, who was arrayed as A.6 for the major offence punishable under Section 302 of the Indian Penal Code in S.C.No.386 of 2004 on the file of the I Additional Sessions Judge, Tirunelveli has come forward to file this Criminal Original Petition seeking to expedite the trial.

2. The learned Government Advocate (Criminal Side) on instruction submitted that Non-bailable warrant issued against A.2 and A.3 are yet to be executed.

3. It is very unfortunate that the case is pending for more than eleven years. Hence, a direction is issued to the respondent to execute the Non-bailable warrant and thereafter, proceed with the trial. The Deputy Inspector General of Police, Tirunelveli District is also directed to supervise the proposed action and see to it that A.2 and A.3 are secured. In spite of the efforts taken, A.2 and A.3 are not secured, then the Court will have to take appropriate steps to split up the case and proceed with the trial with respect to other accused. The entire exercise has to be carried out within a period of eight months from the date of receipt of the copy of this order.

4. With the above direction, this Criminal Original Petition is disposed of.
