For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory bail in Crime No.7 of 2020 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 294(b), 323, 506(ii) of I.P.C., in Crime No.7 of 2020 on the file of the respondent police, seek anticipatory bail.

3. The learned counsel appearing for the petitioner states that the first petitioner would surrender by this week itself and wanted permission to withdraw this petition.

4.Recording the said submission, this criminal original petition is dismissed as withdrawn as far as the first petitioner is concerned. If the first petitioner surrenders before the Court https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.2764 of 2020 below, his bail petition will be considered on merits on the next day of surrender.

5.No serious allegations have been made against the second petitioner. The second petitioner is not having any previous case.

6. Taking note of the facts and circumstances of the case, I am inclined to grant anticipatory bail to the second petitioner with certain conditions. Accordingly, the second petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate Court No.II, Kovilpatti, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the second petitioner shall appear before the respondent police as and when required for interrogation. The second petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.

7. The second petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
