Respondent Petition filed under Section 582 of BNSS, to modify the condition in Crl.MP.[MD}.No.7315/2024 in Crl.A.(MD).No.608/2024 that ''the petitioner shall execute a bond for a sum of Rs.25,000/- with two sureties, each for a like sum, to the satisfaction of the learned Principal Sessions Judge, Tirunelveli'' in stead of '' petitioner shall execute a bond for a sum of Rs.25,000/- with two sureties, of whom, one should be a blood relative, each for a like sum, to the satisfaction of the learned Principal Sessions Judge, Tirunelveli''.

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.,] (1)The present miscellaneous petition is filed by the petitioner seeking modification of the condition imposed on him by this Court vide order dated 15.10.2024 in Crl.MP.(MD).No.7315/2024 in Crl.A.(MD).No. 608/2024.

(2)Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent. (3)This Court, vide the aforesaid order dated 15.10.2024, in Crl.MP. (MD).No.7315/2024, suspended the sentence of the petitioner, a life convict, on condition that the petitioner should execute a bond for a sum of Rs.25,000/- with two sureties, each for a like sum and that, one of the sureties should be of a blood relative. A perusal of the affidavit filed in support of the petition would reveal that though the petitioner's sentence

was suspended as early as on 15.10.2024, he is unable to come out of the prison as he could not produce a surety of a blood relative. (4)Being satisfied with the reasons stated in the affidavit filed in support of this petition, the miscellaneous petition is ordered and the condition imposed by this Court on 15.10.2024, insofar it relates to execution of bond is concerned, is modified and the petitioner shall execute a bond for a sum of Rs.25,000/- [Rupees Twenty Five Thousand only] with two sureties, each for a like sum, to the satisfaction of the learned Principal Sessions Judge, Tirunelveli. The other conditions remain unaltered.
