ORDER : The Court made the following order :- The petitioner/Accused No.4, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 294(b), 323, 324 & 506(ii) of IPC, in Crime No.574 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to the previous enmity with regard to watching the film at theatre, the petitioner along with other accused said to have abducted the defacto complainant and threatened him with dire consequences and also attacked him with bottle. Hence, present case has been registered against the petitioner.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that this is a second anticipatory bail application. Earlier anticipatory bail application filed by the petitioner in Crl.OP(MD)No.21087 of 2022 was dismissed by this Court, on 05.01.2022.

4. The learned Government Advocate (Crl. Side) for the respondent police would submit that earlier anticipatory bail application, filed by the petitioner was dismissed by this Court, on the ground that the petitioner is having bad antecedents and he is having three previous cases. Further, he is also a history sheeted rowdy. According to him, there is no change of circumstance. 5.The learned counsel for the petitioner would submit that the petitioner is having only one previous case. Only on the ground of celebration of birth day, the above said case has been registered against the petitioner.

6.It is seen that considering the bad antecedents of the petitioner, earlier anticipatory bail application was dismissed by this Court. Now, in this petition, I find no change of circumstance. 7.Accordingly, this Criminal Original Petition is dismissed. The petitioner shall surrender before the respondent police or before the concerned Court for regular bail.
