PRAYER: Writ Petitions filed under Article 226 of the Constitution of India for issuance of a Writ of certiorarified mandamus to call for the records pertaining to the impugned order dated 22.01.2026 in RC.No. 14816/A3/2025 of the 2nd respondent served to the petitioner on 1/5
28.01.2026 and consequential relieving order of the 3rd respondent in Mae.Ku.Na.Ka.No.998/A/2026 dated 28.01.2026 and quash the same and consequently direct the respondent to permit the petitioner to continue as a fireman in Thoothukudi Sipcot fire station. ORDER
The petitioner is working as an Upgraded Leading Fireman at Thoothukudi Sipcot Fire and Rescue Station, Thoothukudi and he has been transferred vide the impugned order to Chennai. 2.The learned Senior Counsel appearing for the petitioner by referring to Rule 12 of the Tamil Nadu Fire Subordinate Service Rules submits that the officers, who are below the rank of Station Fire Officers in class 2 shall be transferred from one region to another region by the respective Deputy Directors of Fire Service only by mutual agreement. In this case the petitioner has been transferred from Ramanathapuram to Chennai and in that event there should be a mutual agreement. 2/5
3.Considering the above submission of the learned senior counsel, this court was inclined to grant an order of interim stay. However at the request of the learned Special Government Pleader, for getting instructions this court adjourned the matter. 4.Today, the learned Special Government Pleader appearing for the respondents based on the written instructions submits that there are 7 vacancies in Ramanathapuram district, 1 vacancy in Kanyakumari district and there is no vacancy in any other districts in Tirunelveli and Madurai Region. He further submits that the petitioner can be accommodated either in Ramanathapuram or Kanyakumari district. 5.The learned senior counsel for the petitioner in response to the above submits that the petitioner is willing to join in Kanyakumari district.
6.Considering the rival submissions made, the impugned order is set aside. This writ petition is closed. The respondents shall accommodate the petitioner in the existing vacancy in Kanyakumari 3/5
district. No costs. Consequently connected miscellaneous petition is closed.
