2.The learned counsel for the petitioners would submit that a false case stands foisted against the petitioners. By placing reliance on the 161(3) Cr.P.C. statement of the defacto complainant, wherein, he had admitted to an exaggeration in preferring the complaint, and in informing that the gold chain of his wife had been done away with by the accused. The de-facto complainant had admitted that since the allegations were made against himself and his family members of their having done away with a gold chain belonging to a woman of the accused household, he has indulged in such exaggeration. Therefrom, the learned counsel for the petitioners requires this Court to draw the inference that the entire prosecution case is false. We are unable to do so and the petition is liable to be dismissed.
3.Accordingly, the Criminal Original Petition is dismissed. It is needless to state that it is open to the petitioners to raise all defences before the trial Court. Consequently connected Miscellaneous Petition is closed. Sd/ Assistant Registrar /True copy/ Sub Assistant Registrar(c.s) To 1.The Judicial Magistrate Court, Sivagiri.
