ORDER

This writ petition has been filed to direct the respondents to entertain registration of the proposed partition deed to be executed between the petitioner and his brother Narayanan in respect of land and building bearing Plot No.19, Old T.S.No.3P/29 and New T.S.No.472 Part measuring about 656 sq.mtr., at Jawahar Street, Karaikudi Municipal Town, Karaikudi, Sivagangai District.

2. Heard both sides. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. The case of the petitioner is that he and his brother entered into partition in respect of aforesaid property and in this regard, when the petitioner presented the draft of the partition deed for registration, the same was refused to register by the first respondent on the ground that there is a different in the name of the petitioner. In the petitioner's draft, his name is showing as Ramasamy, whereas his original name is Ramanathan. Hence, the petitioner seeks direction. Page No.2/5

4. At the outset, this Court, without going into the merits of the case, to direct the first respondent to register the document presented by the petitioner, after establishing the identity of a person executing document.

5. With the above direction, this Writ Petition is disposed of. No costs.
