RESPONDENT Criminal Miscellaneous Petition filed U/s.482 of Cr.P.C praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to accept the affidavit filed on behalf of the petitioner/ respondent and grant further 6 months time to complete the investigation and to file the final report.
Prayer in CRL OP(MD). 15840/ 2015 :
Criminal Original Petition has been filed U/s.482 of Cr.P.C. to direct the respondent to file charge sheet in Crime No. 1/2015 under sections 120 (B), 420, 465, 466 r/w 471 and 409 IPC and U/s. 13 (2) r/w 13(1)(c) and (d) of the P.C. Act - 1988 on the file of the respondent, within the time frame fixed by this Court. Order : This Miscellaneous petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.P.Kandasamy Government Advocate (Crl.Side) on behalf of the state and M/s. V.Maharajan, the Counsel for the respondent, the court made the following order:- This is an application filed by the petitioner to grant further 6 months time to complete the investigation and to file the final report in Crime.No.1 of 2015 on the file of the learned Deputy Superintendent of Police, Vigilance and Anti Corruption Wing, Pudukkottai District.
2.Heard and perused the material records.
3.It is stated in the affidavit enclosed with the petition filed by the petitioner that the investigation of the present case has been completed and certain accused are public servants and https://hcservices.ecourts.gov.in/hcservices/
sanction order as against them are yet to be received from the sanctioning authority to prosecute the accused before the Court of law. It is further stated that on obtaining the said sanction order, the petitioner would complete the investigation and file the final report before the learned Chief Judicial Magistrate, Special Court, Pudukkottai. Further, the allegation regarding misappropriation in Indira Awaas Yojana(IAY) Scheme, have been made. On the Outcome of the preliminary enquiry the DVAC has obtained permission from the learned Vigilance Commissioner, Chennai in letter No. 4259/ VC-I/ 2014-I and also registered a regular case in Cr.No.1/2015 against the accused.
4.Having considered the above mentioned facts and circumstances this Court is satisfied to grant further 6 months time to file the final report.
5.Accordingly, this petition is allowed as prayed for.
