The present writ petition is filed for a certiorarified mandamus to quash the impugned order and to direct the respondents to consider the petitioner's appeal dated 23.09.2025.
2. The learned Government Advocate for the respondents submits that the said appeal was preferred with a delay of 20 days and hence, the first respondent has already dismissed the said appeal on the ground of limitation.
3. Admittedly, the appeal was preferred with a delay of 20 days. Even though the petitioner claims that he is not well, there is no evidence to prove the same. However, since there is only 20 days delay, this Court is inclined to set aside the impugned order by condoning the delay of 20 days and remand the matter to the first respondent for reconsideration on 2/4
payment of cost of Rs.3,000/- to Creche, attached to the Women Advocates Association, Madurai Bench of Madras High Court, Madurai (Account No:6477041768, IFSC Code:- IDIB00H040, Indian Bank, High Court Branch, Madurai). On payment, the delay is condoned and the matter is remanded back to the first respondent and the first respondent is directed to consider and pass appropriate orders on the appeal within six (6) weeks from the date of receipt of a copy of this order.
