Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as A4 in Crime No.616 of 2015 on the file of the respondent police apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 506(ii) and 307 of I.P.C., r/w 25(1-B)(a) of Indian Arms Act and hence, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other accused went to the de-facto complainant's land and threatened him with dire consequences.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case and it is a case and case in counter.

4.By order dated 06.11.2015, this Court granted anticipatory bail to the other accused and dismissed the petition in respect of the petitioner herein. Now, the petitioner has come out with the present petition stating that the petitioner is a heart patient and he was admitted in hospital and after taking treatment, he discharged from the hospital and he also produced discharge summary before this Court. 5.The learned Government Advocate (Crl.side) on instruction would submit that the petitioner is having three previous cases. 6.Considering the facts and circumstances of the case and also considering the change of circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. 7.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Natham and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the https://hcservices.ecourts.gov.in/hcservices/

satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C.
