O R D E R

This Writ Petition has been filed challenging the impugned notification dated 06.11.2025 passed by the fifth respondent and to quash the same as illegal, void and arbitrary, and consequently to direct the fifth respondent not to proceed further until the disposal of the civil suit pending in O.S.No.231 of 2020 on the file of the Principal District Munsif Court, Thirumangalam.

2. The learned counsel for the petitioners would submit that the subject property is in the possession of the petitioners. It is further submitted that the first petitioner has already filed a suit in O.S.No.231 of 2020 before the Principal District Munsif Court, Thirumangalam, seeking permanent as well as mandatory injunction against the fifth respondent. According to the petitioners, during the pendency of the said suit, the respondents have initiated steps which would affect their possession and rights over the property. The learned counsel would further contend that the property originally belonged to the temple and that the alleged alienation in favour of third parties is not in accordance with law. It is his submission that unless the rights are adjudicated by the competent civil Court, the respondents cannot proceed on the basis that the property absolutely vests with them.

3. This Court has carefully considered the submissions made by the learned counsel for the petitioners. Admittedly, a civil suit in O.S.No. 231 of 2020 is pending before the competent Civil Court with regard to the very same property. The issues raised by the petitioners involve disputed questions of fact relating to title and possession, which are matters to be adjudicated before the Civil Court. 3/6

4. Insofar as the impugned notification is concerned, this Court does not find any ground to interfere in exercise of its jurisdiction under Article 226 of the Constitution of India. If the petitioners are in possession of the property, it is always open to the respondents to proceed only in accordance with due process of law.

5. In view of the above, this Court is not inclined to entertain the writ petition.
