ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody for the offences punishable under Sections 2(16)(a)(b)(c), Part III Section V, Section 39(1)(a)(b)(d), 39(3)(a)(b)(c), 49 A(a)(b)(c), Part VI Section 50 and 51(1) of Wild Life Protection Act, 1972, in W.L.O.R.No.03 of 2025 on the file of the respondent, seeks bail.
2. The prosecution case is that the petitioner, along with other accused persons, was in illegal possession of 400 kg of sea cucumber. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is in judicial custody. Hence, he seeks bail to the petitioner.
4. The learned Additional Public Prosecutor submitted that the petitioner, along with other accused persons, was in illegal possession of 2/4
400 kg of sea cucumber. Therefore, he opposed for grant of bail to the petitioner.
5. Considering the facts and circumstances of the case and also considering the nature of the offence, this Court is inclined to grant bail to the petitioner.
