Mr.R.Suresh Kumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.213/2022 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/2nd accused, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 324 and 506(ii) of IPC in Crime No.213 of 2022 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused persons said to have threatened the defacto complainant with dire consequences and also attacked him and caused injury. Hence, the complaint. 1/3

3.The learned counsel for the petitioner would submit that this the sixth application filed by the petitioner. The earlier applications filed by the petitioner was dismissed by this Court.

4.The learned Government Advocate (Crl. Side) would submit that even though the earlier applications were dismissed by this Court, the petitioner has not surrendered either before the concerned Court or before the respondent police. The petitioner is having five previous cases and a history sheeted person. Hence, he opposes the grant of anticipatory bail to the petitioner. 5.Since there is an earlier direction to the petitioner to surrender either before the concerned Court or before the respondent police, the petitioner has to comply the same.

6.I find no change of circumstances, to grant anticipatory bail to the petitioner. 7.With the above said directions, this criminal original petition stands dismissed.
