PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to renew petitioner's passport on the basis of the petitioner's application dated 20.12.2024 pending in File No. TR2077231039124 within a time frame. ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent to reissue the passport to the petitioner based upon his application dated 20.12.2024.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.140 of 2021, on the file of the second respondent. So far investigation has not been completed and charge sheet has not been filed.

3. A perusal of the complaint reveals that it is a dispute between the brothers due to the inter-caste marriage by one of them.

4. This Court in a judgment reported in 2014 (8) MLJ 61 has held that mere pendency of FIR is not a legal impediment for issuance of the passport.

5. Considering the allegations in the FIR and non-filing of the charge sheet, there is no legal impediment for the first respondent to consider the 2/4

request of the petitioner for issuance of the passport. The first respondent is directed to consider the application of the writ petitioner and pass orders within a period of 4(four) weeks from the date of receipt of a copy of this order.

6. With the above said observations, this writ petition stands disposed of. No costs.
