Respondents PRAYER : Petition filed under Section 528 of BNSS, 2023 to direct the 1st respondent to transfer the investigation in crime no. 126 of 2025 on the file of the 3rd respondent to any other competent officer or specialized agency such as CBCID in order to ensure a fair, impartial and proper investigation and to call out the truth.

ORDER

This petition has been filed seeking to transfer the investigation of the case in crime no. 126 of 2025 on the file of the 3rd respondent to any other competent officer or specialized agency such as CBCID in order to ensure a fair, impartial and proper investigation

2. The learned counsel appearing for the petitioner submitted that the petitioner's wife's health got deteriorated drastically at the time of delivery when she was admitted in the local area hospital, wherein baby was born. Due to the low pulse level, the child was referred to Rio Hospital at Madurai. However,even after shifting the petitioner's wife to Madurai Hospital, she died. Since there has been no progress in the investigation, this petition came to be filed.

3. Per contra, the learned Government Advocate appearing for the respondent police submitted that the investigation is ongoing.

4. In view the same, this Court directs the second respondent to monitor the investigation conducted by the third respondent. Accordingly, this Criminal 2/4

Original Petition is disposed of with a direction to the third respondent to appraise the progress of the investigation to the second respondent every Friday.
