PETITION FOR MODIFICATION Under Section 528 of BNSS PRAYER :- To modify the condition No.(b) imposed on the petitioner / accused No.3 by this Court in Crl.O.P(MD)No.128 of 2026 on 07.01.2026.

ORDER : The Court Made the following order :- This petition has been filed to modify the condition imposed on the petitioners in Crl.O.P(MD)No.128 of 2026, dated 07.01.2026.

2. The learned counsel for the petitioner submitted that the petitioner is a sick person and was in Sacred Heart Hospital, Tuticorin, on the date and time of the alleged occurrence. He further submitted that the petitioner is the sole breadwinner of his family and is a respectable, law-abiding citizen. Therefore, he prays for modification of the said condition.

3. The learned Government Advocate (Crl. Side) submitted that the petitioner has been complying with the condition for nearly 96 days. 2/4

4. Considering the said submission, the condition imposed by this Court in Crl.O.P.(MD)No.128 of 2026 dated 07.01.2026 is modified to the effect that ''the petitioner shall stay at Tirunelveli, report before the Inspector of Police, Town Police Station, Tirunelveli, daily at 10.30 a.m., until further orders.''

4. Accordingly, this petition is allowed.
