Prayer : Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Certiorarified Mandamus, calling for the records and the impugned order passed by the second respondent dated 17.02.2021 and quash the same and consequently direct the second respondent to give permission and protection to conduct Gramia Cultural Programme of Arulmigu Sri Kaliamman Thirukovil Maasi Urchava Festival at Srirengapuram, Theni District on 22.02.2021. By consent, this Writ Petition is taken up for final hearing at the admission stage itself.

2. The petitioner has filed this petition seeking permission to conduct Cultural Programme in connection with Arulmigu Sri Kaliamman Thirukovil Maasi Urchava Festival at Srirengapuram, Theni District on 22.02.2021.

3. Mr.A.Robinson, learned Government Advocate (Criminal Side), who accepts notice on behalf of the respondents, on instructions, would contend that the petitioner's representation was rejected by the second respondent on 17.02.2021 citing the present Covid-19 pandemic situation. However, he would submit that since certain relaxations are made by the Government in the subsequent Government Orders, they are ready to consider the fresh representation, if submitted by the petitioner.

4. Considering the said submissions made by the learned Government Advocate (Criminal Side), the petitioner, if so advised, can file a fresh petition before the District Collector, Theni District and on receipt of the same, the District Collector shall consider and pass appropriate orders on merits and in accordance with law within a period of two weeks from the date of receipt of the representation of the petitioner.

5. With the above observation, this petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
