O R D E R

[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted to direct the respondents to remove the encroachment made by the fourth respondent in Survey No.B 12/2/2/ of Maruchukatti Kanmai, Sivagangai Town, Sivagangai District.

2. With reference to the relief sought for in the present writ petition, the learned Additional Government Pleader appearing on behalf of respondents 1 to 3 would submit that the authorities would conduct survey, identify the encroachment and remove the same by following the procedures.

3. The learned counsel appearing for the fourth respondent would submit that the fourth respondent is in occupation of patta.

4. In view of the submissions made on behalf of respondents 1 to 3, respondents 1 to 3 are directed to conduct survey, identify the encroachment and remove the same by following the procedures as 2/4

contemplated under the Act and Rules within a period of twelve weeks from the date of receipt of a copy of this order. The fourth respondent is at liberty to submit his explanation along with document to establish his case.

5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
