This Criminal Original Petition has been filed for a direction to the respondent police to take steps to file an appeal against the judgment dated 03.06.2014 made in C.C.No.265/11 passed by the learned District Munsif cum Judicial Magistrate, Bodinayakkanur. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondent. 3.As a legal heir is also governed by the definition of 'victim' under the Code of Criminal Procedure and in keeping with the amended proviso to Section 372 there of, a right of appeal is provided, this petition shall stand dismissed. Any delay occasioned in preferring an appeal may be explained by informing that this Court erroneously has been moved by way of this present Criminal Original Petition.
