ORDER

This Criminal Original Petition has been filed seeking a direction to direct the Respondent 1 and 2 to execute the Court fresh Non Bailable Warrant issued on 23.11.2021 and secured the Accused and produce before the Judicial Magistrate No.II Fast Track Court, at Magistrate level Madurai.

2.The petitioner is the complainant in STC No.302 of 2016 for the alleged offence under Section 138 of the Negotiable Instrument 1/3

Act against the fourth respondent herein. The fourth respondent did not appear before the trial Court, as such the trial Court has issued Non Bailable Warrant against him and the same is pending on the file of the second respondent. Till today, it was not executed and it is pending.

3. The Additional Public Prosecutor would submit that the fourth respondent is not living living in the address given by the petitioner.

4. Considering the above, the second respondent is directed to execute the Non Bailable Warrant issued as against the fourth respondent in STC No. 302 of 2016 with the period of six weeks from the date of receipt of a copy of this order on condition that the petitioner shall co-operate with the second respondent for execution of warrant by giving correct address of the fourth respondent.

5. With the above direction, the Criminal Original Petition stands disposed of.
