ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 17.09.2025 for the 1/5

offences punishable under Sections 8(c) r/w 20(b) (ii)(c) and 25 of NDPS Act, in Crime No.178 of 2016 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner was found illegal custody of 100 kgs of Ganja. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He would further submit that the petitioner is no way connected with the case, a false case has been lodged as against the petitioner. He would further submit that the petitioner is in custody from 17.09.2025. Hence, he seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the contraband recovered from the petitioner is a commercial quantity. He would further submit that it is a case of jumped out bail, the trial is not yet completed. He would further submit that when the coaccused convicted on the date of pronouncing judgment, the petitioner slipped from the Court. However, he objected to grant bail to the petitioner.

5.Recording the submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is dismissed. The trial court is directed to pronounce the judgment within a period of two weeks from the date of receipt of a copy of this order.
