Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the 1st and 2nd respondent herein to consider the petitioner's representation dated 22.01.2024 seeking warrant interference of the 2nd respondent and to call for the entire records of the accounts maintaining by the 3rd respondent society and other relevant records and scrutinize the same and to appoint an officer as a fit person to administering the 3rd respondent society in order to ensure the functioning of the society in appropriate manner and maintaining the funds which utilize toward the welfare of the members of the society and dispose the same as earlier as possible.

ORDER

Heard the learned counsel for the petitioner and the learned Special Government Pleader for R1 & R2.

2. The petitioner is a member of the third respondent welfare society registered under the provisions of the Tamil Nadu Societies Registration Act, 1978. The petitioner alleges that the affairs of the society are being mismanaged. He wants action to be taken by the authorities. In such matters, unless the petitioner is able to mobilze members on his side, the writ Court will 2/4

not be justified in issuing any direction. I therefore decline to issue any direction as sought for. At the same time, I must observe that if the society has not been submitting the annual returns, action as per the provisions of the Act must be taken by the respondents 1 & 2.
