RESPONDENT/PETITIONER Civil Miscellaneous Petition praying that in the circumstances stated therein and in the petition affidavit filed therewith the High Court will be pleased to accept the affidavit filed by the petitioner and grant further 3 months time to file final report in Cr.No. 593 of 2014 on the file of the Vadipatti Police Station, Madurai District. Prayer in CRL OP(MD). 21408/ 2015 :
Criminal Original Petition filed under section 482 of Cr.P.C., praying to direct the 2nd respondent to file a final report in Cr. No. 593 of 2014 on the file of the 2nd respondent police. Order : This Criminal Miscellaneous petition coming on for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.P.Balasubramani, Government Advocate for the petitioners and of Mr.V.Thirumal, Advocate for the petitioner in Crl.OP.No.21408/15 and the court made the following order:- The petitioners / respondent Police have filed this criminal miscellaneous petition, under Section 482 of the Code of Criminal Procedure, seeking further three months of time to complete the investigation in Crime No.593 of 2014 and file a final report.
2. Heard Mr.A.P.Balasubramani, learned Government Advocate (Criminal Side) appearing for the petitioners / respondent Police and Mr.V.Thirumal, learned counsel appearing for the respondent / petitioner.
3. The petitioners / respondent Police, in the accompanying affidavit, have stated that:
"6. I humbly submit that as per the orders of this Hon'ble Court the petitioner police investigate the matter in accordance with law and in speedy manner. Further the petitiioner police taking sincere efforts for collect the original sale document from the Accused No.1 namely Elangovan but his whereabouts of the said Elangovan and his https://hcservices.ecourts.gov.in/hcservices/
mother is not known and subsequently the petitioner police approached the Sub Registrar's Office, Vadipatti and obtained the photocopy of the said document and also obtained the sample signature from the defacto complainant, sent the same to the Finger Print Experts for comparison. But, the same was returned for want of original document.
7. I humbly submit that immediately the petitioner police again approached the Sub-Registrar's Office, Vadipatti and obtained the original signature of the defacto complainant from the Office record and his sample signature, were sent to finger print expert and awaiting for the result from the Finger Print Expert. The petitioner police almost complete the investigation of this case and after receiving the report from the finger print expert will file final report before the concerned authorities as early as possible."
4. Taking into consideration the above facts, the second petitioner / second respondent Police is given four months time, from the date of receipt of a copy of this Order, to complete the investigation in Crime No.593 of 2014 and file a final report, as directed by this Court on 06.11.2015.
