ORDER : The Court Made the following order :- The petitioner/Accused No.1, who was arrested and remanded to judicial custody on 29.09.2015 for the alleged offences punishable under Sections 395, 397, 406 and 120(b) of IPC, in Crime No.375 of 2015 on the file of the respondent police and hence, seeks bail. 2.The case of the prosecution is that on 24.09.2015 on Sangili Pandi, Branch Manager, Manapuram Finance lodged a complaint that some unknown persons conspired together and committed offence of robbery by taking the cash amount of Rs.16,54,461/- along with jewels in Manapuram Finance Ltd., Batlagundu by entering into the finance after plucking the locker key from Security by putting a knife on his neck. Therefore, the case has been registered for the above said offences.
3.The case of the petitioner is that his name is not in the FIR and only based on the confession of the sixth accused, this petitioner has been falsely implicated in this case and he is in judicial custody for the past 60 days.
4.The learned Government Advocate (Crl.side) submitted that this petitioner and A6 are employees of Manapuram Finance and they committed fraud by replacing the 18 carrot gold instead of 22 carrot gold. When the fraud was found in the Audit the petitioner and A6 conspired with other accused and committed robbery. 5.Considering the gravity and seriousness of the offence and the investigation is pending, I am not inclined to grant bail to the petitioner.
