ORDER

This petition is filed seeking to quash the impugned FIR in Crime No.911 of 2021, dated 29.07.2021 for the offence under Sections 294(b), 323, 324 and 506(ii) of IPC, on the file of the respondent Police. 2.The gist of the allegations is that in the year 1985, the petitioner and his friends formed an Auto stand sangam, which is near to Rengavilas, Manaparai, Trichy District. Thereafter, the defacto complainant's son namely, Balaji also joined the said Auto Sangam and started running his Auto. Further, the petitioner and his friends imposed a condition that the defacto complainant should not park his Auto in the stand. Thereafter, on 25.07.2021, at about 08.00 p.m., the petitioner along with other accused created a problem and assaulted the defacto complainant and his son and threatened them with dire consequences. Thereafter, the defacto complainant went to Manapparai Government Hospital, and took treatment as outpatient. Hence, the present complaint. 2/6

3.The learned counsel appearing for the petitioner submitted that on 24.07.2021, the defacto complainant warned the petitioner not to park the petitioner's Auto in their Auto Stand. As a result of which, a wordy altercation arose between them and the petitioner sustained injuries following which, he was admitted on 24.07.2021 at Manapparai Government Hospital and took a treatment as inpatient till 27.07.2021. Based on his complaint and after receiving information from the Manapparai Government Hospital, the first respondent police registered a case in Crime No.908 of 2021, dated 25.07.2021, for the offence under Sections 294(b), 323, 324 and 506(ii) of IPC. Thereafter, on 29.07.2021, the defacto complainant lodged the complaint as against the petitioner stating that he was injured by the attack of the Petitioner on 25.07.2021 and the learned counsel appearing for the petitioner emphatically contended that he was admitted in the hospital on the said date. Hence, he sought the indulgence of this court to quash the FIR in Crime No.911 of 2021.

4.The learned Government Advocate (Crl. Side) Mr.M.Sakthi Kumar, on instructions, submitted that it is a case and case in counter 3/6

between the petitioner and the defacto complainant. The disputed facts are matters to be dealt with by the trial Court during the course of the trial. Hence, he sought dismissal of this petition. 5.Heard the learned counsel on either side and perused the materials available on records.

6.A careful perusal of the materials and records placed before this Court would undoubtedly prove that the petitioner was admitted in the hospital during the period from 24.07.2021 to 27.07.2021. Both outpatient slip as well as the discharge summary have been placed before this Court issued by the Manapparai Government Hospital. Hence, this Court is of the considered opinion that allowing the respondent police to continue with the investigation in Crime No. 911 of 2021 would amount to a clear abuse of the process of law and would defeat the ends of justice.

7.Accordingly, this Criminal Original Petition is allowed and the impugned FIR in Crime No.911 of 2021, dated 29.07.2021, is hereby 4/6

quashed. Consequently, the connected Criminal Miscellaneous Petition is closed.
