ORDER

The petitioner has come forward with this application, praying to direct the Judicial Magistrate, Padmanabhapuram, to dispose of C.C.No.346 of 2009 on his file within a time frame to be fixed by this Court. .

2.Heard the learned counsel for the petitioner and perused the materials available on record.

3. Even though the 2nd respondent is not a party, no prejudice would be caused, if a direction for speedy trial is ordered.

4. It is represented by the Government Advocate (crl.side) that there are 27 witnesses to be examined and the matter is posted on 08.12.2015 for examination of P.Ws.2 and 5.

5. Taking note of the fact that the matter is pending from 2009, the Judicial Magistrate, Padmanabhapuram is directed to take the Calender Case in C.C.No.346 of 2009, and proceed with the https://hcservices.ecourts.gov.in/hcservices/

same on day-to-day basis and the matter shall not be adjourned beyond three working days, at any point of time, and take a decision as expeditiously as possible.

6. With the above direction, this Criminal Original Petition is disposed of.
