RESPONDENT/DEFACTO COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to dispense with the personal appearance of the petitioner in C.C.No.95/2017 on the file of the Judicial Magistrate, Eraniel pending disposal of the above quash petition. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.RAMASAMY, Advocate for the petitioner, while admitting the Crl.OP.

, the court made the following order:- The petitioner is directed to appear before the Trial Court, within a period of two weeks from the date of receipt of a copy of this order and on such appearance, he shall be released on bail under Section 436 of the Code of Criminal Procedure on the same day on he executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Eraniel. Thereafter, the presence of the petitioner before the Trial Court shall be dispensed with after getting an undertaking from him that in the event of Crl.O.P. (MD)No.7515 of 2017 being dismissed by this Court, he shall voluntarily appear before the Trial Court without waiting for further summons.
