ORDER : The Court Made the following order :- The petitioner/sole Accused, who was arrested and remanded to judicial custody on 16.09.2015 for the alleged offences punishable under Sections 364 and 302 of IPC, in Crime No.390 of 2015 on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that the deceased stolen the Laptop of the petitioner and hence, the petitioner assaulted the deceased and murdered him.

3.The case of the petitioner is that he is an innocent person and he has not committed any offence and he is studying in Polytechnic and he secured 1020 marks in +2 Examination and he is in judicial custody from 16.09.2015 4.The learned Government Advocate (Crl.side) submitted that the deceased was 10 years old boy and the petitioner's Laptop was stolen by the deceased and the same was questioned, due to which, the motive arose and the petitioner assaulted the deceased and caused death and the investigation is pending.

5.Considering the facts and circumstances of the case and also considering the fact that the petitioner is a Polytechnic Student and he is in judicial custody from 16.09.2015, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Pudukottai and on further condition that the petitioner shall appear before the respondent police daily at 05.00 p.m., until further orders. sd/- 30/11/2015 / TRUE COPY / https://hcservices.ecourts.gov.in/hcservices/ Sub-Assistant Registrar (C.S.)
