For Respondent :Mr.R.Sivakumar, Government Advocate (Crl. side) PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.128 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 457 and 380 IPC, in Crime No.128 of 2021, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that while the defacto complainant was driving his Lorry, the accused waylaid him, demanded money and also stolen Rs.1,000/-, Original driving license and a cell phone. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.
4.The learned Government Advocate (Criminal side) would submit that on 05.07.2021, there were three occurrences and in the confession given by the accused Surya, the petitioner was implicated and in the confession statement, the said Surya has specifically stated that the petitioner was involved in all the three incidents. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.3287 of 2022 5.Considering the seriousness and gravity of the offence alleged against the petitioner and also the facts that some of the property are yet to be recovered, that the three accused are yet to be secured and that investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioner. 6.In the result, this Criminal Original Petition is dismissed. sd/- 16/02/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
