ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused , in Crime No.Not known of 2015 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 417 and 506(i) I.P.C. and hence, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant financially helped the petitioner and wanted to marry the petitioner. The petitioner expressed his unwillingness to marry her and criminally intimidated her and thereby a complaint has been given by the defacto complainant and a case has been registered for the offences under Sections 417 and 506(i) I.P.C.
3. The case of the petitioner is that the petitioner is working as Assistant Surgeon at Primary Health Centre at Mathiyanallur Village, Pudukkottai District. The defacto complainant is aged about 46 years and she has married with another person. She is having two children. In the year 2010, she came to the petitioner for taking treatment of her mother. On seeing the petitioner's prosperity and his name standing in the society, the defacto complainant wanted to marry the petitioner. When the petitioner refused, the defacto complainant gave various complaints in various police stations viz., Keeranur Police Station, Illuppur Police Station and Ganesh Nagar Police Station and finally to this respondent. The respondent police, after enquiry, filed a report to https://hcservices.ecourts.gov.in/hcservices/
the effect that the complaints given by the defacto complainant are false. Now she has given the present complaint only to extract money from the petitioner. The petitioner is innocent and he has not committed any offence.
4.The learned Government Advocate (Crl.Side) submitted that on receiving money, the petitioner had given promise to marry her and subsequently he refused to marry her and the investigation is pending.
5.Considering the fact that the defacto complainant has given number of complaints previously before various police station and the said complaints were already closed, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Pudukkottai, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 05.00 p.m. for a period of two weeks and thereafter as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
