ORDER : The Court made the following order :- When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) would submit that the petition enquiry is pending in CSR.No.150 of 2022.
2.The learned counsel for the petitioners would submit that the petitioners have already appeared twice before the respondent police.
3.Considering the rival contentions of both the counsels, the petitioners are directed to appear before the respondent police on 24.02.2022 at 11.00 a.m., and on such appearance, the respondent police is directed to proceed with the enquiry and conclude the same within a period of two weeks. Thereafter, if the respondent police come to the conclusion that cognizable offence is made out against the petitioners, an FIR can be registered, but the petitioners will https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.3270 of 2022 be given due notice of the same so as to enable them to move the concerned Court for appropriate relief or otherwise, the respondent police is at liberty to close the complaint if no further action is necessary.
4.The learned counsel for the petitioners would further submit that the first petitioner is a senior citizen aged 85 years and the second petitioner is a physically challenged person. Hence, the respondent police is directed to not to arrest them till the completion of enquiry.
5.With the above directions, this Criminal Original Petition is disposed of.
