ORDER
This contempt case has been filed complaining willful disobedience of the order dated 08.07.2024 in W.P.(MD)No.14936 of 2024.
2. While disposing the said writ petition, this Court directed the 2nd respondent therein to consider the petitioner's representation on its own merits and pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of copy of the order. Complaining that this order is not complied with within the time stipulated though it is personally served to the respondents on 20.09.2024 and sent by registered post on 20.11.2024, the learned counsel for the petitioner sought to punish the respondents.
3. On the other hand, based on the averment made in the counter affidavit filed by the respondent, the learned counsel for the respondent would submit that they received the order copy only on 10.12.2024 and thereafter, they considered the representation of the petitioner as directed by this Court and passed orders on 31.01.2025 and the same was sent to the petitioner by registered post. But it is unserved due to nonavailability of the petitioner.
4. The learned counsel for the petitioner submits that the said order is not served on the petitioner till date. Across the Bench, the learned
counsel for the respondents served a copy of the order to the petitioner. Considering the fact that the date of order passed by the respondents is 31.01.2025, which is much earlier to filing of this contempt petition on 04.02.2025, in our considered view, the order of the Court is complied with by the respondent.
5. Accordingly, this Contempt Petition stands closed. The petitioner is at liberty to challenge the order passed by the respondent, dated 31.01.2025 if he is so advised.
