PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the second respondent produce the person or body of the detenue namely Gayathri, Daughter of Ravi, aged about 20 years before this Court and set her at liberty For Petitioner : Mr.A.Mohan For Respondents : Mr.S.Chandrasekar No.1 & 2 Additional Public Prosecutor

ORDER

This petition has been filed seeking directionto direct the second respondent produce the person or body of the detenue namely Gayathri, Daughter of Ravi, aged about 20 years before this Court and set her at liberty.

2. It is the grievance of the petitioner that her daughter Gayathri was kidnapped by the third respondent who is a married man. She had given a complaint with regard to missing of her daughter and a case in Crime No.59 of 2020 was registered for the offence under Sections 366 of IPC on 02.02.2020. Since the police did not take any action the present petition has been filed to produce the detenue Gayathri.

3. When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that on the complaint https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD) No.2884 of 2020 given by the petitioner, a case in Crime No.59 of 2020 was registered for the offence under Sections 366 of IPC on 02.02.2020. The complaint of the petitioner is that her sister's son-in-law had kidnapped her daughter. During the course of enquiry the alleged victim Gayathri appeared in person before the respondent police and had stated that due to the harassment made by her family members she had gone to her aunt's place on her own volition whereas her mother has given a complaint as if the said Sarvanan had kidnapped her. During the enquiry, the husband of the petitioner was also present before the respondent police and the alleged victim/detenue has agreed to go along with her father and after recording the statement she was allowed to go with her father and the alleged detenue was neither kidnapped not kept in illegal detention by anybody.

3. Recording the same, this Criminal Original Petition is closed.
