ORDER : The Court Made the following order :- The petitioner, who is arrayed as A6, in Crime No.227 of 2014 on the file of the respondent police, was arrested on 08.10.2015 for the alleged offences punishable under Sections 341, 147, 148, 362, 397, 120(b) and 414 of I.P.C., and hence, seeks bail.
2. The case of the prosecution is that on 29.03.2015, when the defacto complainant came on Bolero car along with his driver with the collection amount, the petitioner along with other accused conspired together and waylaid the de-facto complainant with deadly weapons and took away the amount of Rs.26, 86,000/-.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged occurrence and totally there are 14 accused were involved in this case and the petitioner has not committed any offence as alleged by the respondent police.
4.The learned Government Advocate (Crl.side) submitted that the petitioner is having 15 previous cases and this petitioner along with other accused waylaid the de-facto complainant and took away the amount of Rs.26,86,000/- and the investigation is pending and the amount is yet to be recovered.
5.The learned counsel for the petitioner submitted that the coaccused was already arrested and released on bail by this Court on 25.09.2015 in Crl.O.P.(MD).No.18472 of 2015. He further submitted that earlier the petitioner has filed an application in Crl.O.P.(MD).No.21233 of 2015 and the same was dismissed as withdrawn on 05.11.2015. https://hcservices.ecourts.gov.in/hcservices/
