PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to pass an order directing the first respondent to register a case on the basis of the order passed by the Judicial Magistrate Court, Aruppukkottai, Virudhunagar District in Cr.M.P. No. 868/2020, dated 20.02.2020, in the petition filed under section 156(3) of Cr.P.C.

ORDER
This petition has been filed seeking direction to direct the first respondent to register a case on the basis of the order passed by the Judicial Magistrate Court, Aruppukkottai, Virudhunagar District in Cr.M.P. No. 868/2020, dated 20.02.2020, in the petition filed under section 156(3) of Cr.P.C.
2.The petitioner has lodged complaint before the first respondent against the respondents 2 to 4 herein . However it was not enquired by the first respondent, as such the petitioner was constrained to file a complaint before the learned Judicial Magistrate, Aruppukottai seeking direction under Section 156(3) of Cr.P.C in Crl.M.P.No.868 of 2020. The learned Magistrate has forwarded the complaint to the first respondent directing to conduct enquiry and report by an order dated 20.02.2020. The first respondent without even registering any First Information Report and without issuing notice to the petitioner had conducted enquiry, closed the same and reported the same to the learned Judicial Magistrate, Aruppukottai on 12.05.2020 itself. https://hcservices.ecourts.gov.in/hcservices/ 1/2
3.In view of the same, the closure report filed by the first respondent is hereby set aside and the first respondent is directed to register the First Information Report first as directed by the learned Judicial Magistrate, Aruppukottai vide order dated 20.02.2020 in Cr.M.P.No.20.02.2020 to complete the investigation within a period of eight weeks from the date of registration of the First Information Report.
4.With the above direction, the Criminal Original Petition is disposed of.
