ORDER
This Criminal Original Petition has been filed seeking to modify the condition imposed by the learned Principal Sessions Judge, Tirunelveli, in the order dated 1/3
23.01.2025, passed in Crl.M.P.No.329 of 2025, from 'the petitioner shall report and sign before the second respondent Police daily at 10 a.m. for the period of one month' to 'the petitioner shall report and sign before the first respondent Police'.
2. Mr.M.Laxmi Mahendraa, learned counsel appearing for the petitioner, submits that the petitioner has substantially complied with the condition. He further submits that the petitioner is residing at Thirunelveli District and he is facing difficulty in coming to Madurai and sign before the second respondent-Police. Hence, he prays for modification of the said condition.
3. Mr.K.Sanjai Gandhi, learned Government Advocate (Crl. side) appearing for the Respondent-Police, submits that the petitioner has complied with the condition regularly.
4. Considering the facts and circumstances of the case, this Court is inclined to modify the condition (c) imposed on the petitioner by the learned Principal Sessions Judge, Tirunelveli, in Crl.M.P.No.329 of 2025 vide order dated 23.01.2025.
5. Accordingly, the condition (c) imposed by the learned Principal Sessions Judge, Tirunelveli in Crl.M.P.No.329 of 2025, dated 23.01.2025, is hereby modified to the effect that the petitioner shall appear before the first respondent-Police twice a week i.e., on every Monday and Friday at 10.30 a.m., until further orders. The other conditions shall hold good.
