PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the 1st Respondent to order change of investigation in the matter relating to the Crime No.8 of 2023 on the file of the 3rd Respondent Police and entrust the same to Respondent No.4 for investigation of the case and file a Charge Sheet before the appropriate 1/4

ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the 1st Respondent to order change of investigation in the matter relating to the Crime No.8 of 2023 on the file of the 3rd Respondent Police and entrust the same to Respondent No. 4 for investigation of the case and file a Charge Sheet before the appropriate Jurisdictional Magistrate within the time stipulated by this Court.

2. The learned Government Advocate (Crl. Side) would submit that during the course of investigation, it was found that it is a self accident that was made by the rider himself. Even the CCTV footage have been verified, but no clue have been found out, since it has no capacity to store. The above said investigation was also undertaking on the basis of the order that has been passed by this Court. 2/4

3. The above said investigation shall be supervised or monitored by the second respondent herein. In the mean time, the petitioner is directed to appear before the third respondent and give further statement with regard to his grievances and other facts, which are relevant according to him.

4. The second and third respondent is directed to complete the investigation process within a period of four months from the date of receipt of copy of this order.

5. With the above side directions, this Criminal Original Petition is disposed of.
