For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in crime No.779 of 2008 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No. 3, who apprehend arrest for the alleged offence under Section 6(4) of TNSC (RDCS) order 1952, r/w 7(1)(9) of EC Act in connection with Non-Bailable Warrant issued in C.C.No.145 of 2010, on the file of the learned Judicial Magistrate No.II, Ramanathapuram, seeks anticipatory bail. 2.The petitioner are absent during the trial in C.C.No.145 of 2010, on the file of the learned Judicial Magistrate No.II, Ramanathapuram. Therefore, Non-Bailable Warrant came to be issued on 27.09.2019.

3.The learned counsel appearing for the petitioner undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail.

CRL OP(MD). No.2729 of 2021 4.Considering the undertaking given by the petitioner, the petitioner is directed to appear before the C.C.No.145 of 2010, on the file of the learned Judicial Magistrate No.II, Ramanathapuram, within a period of two weeks from the date of receipt of copy of this order and to file a petition to recall the NBW issued against him. The concerned Magistrate is directed to consider the same on merits and pass orders on the same day.
