ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 and 2, in Crime No.444 of 2015 on the file of the respondent police, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(C) r/w 20(b)(ii) of NDPS Act and hence, seek anticipatory bail.
2. The case of the prosecution is that the respondent police conducted a raid along with his police party at the place of occurrence and on seeing the police party, the petitioners ran away from the scene of occurrence and the respondent police seized 1.50kg of Ganja and a case has been registered.
3. The case of the petitioners is that there is no recovery from the petitioners and the petitioners were not at all presented at the time of occurrence. The contraband seized by the respondent police is below commercial quantity. 4. Considering the gravity of offence, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
