O R D E R

[Order of the Court was made by T.S.SIVAGNANAM, J.] This Writ Petition, styled as a Public Interest Litigation, has been filed, seeking for issuance of a Writ of Mandamus, to direct respondents 1 and 2 to shift the temporary paddy Procurement Centre functioning in 3rd respondent's private land in S.No.355/2D to an extent of 0.20.0 Hectares situated at T.Velangudi Village, Narikudi Panchayat Union, Thiruchuli Taluk, Virudhunagar District to the Government based public place in 151-Pattamangalam Primary Agricultural Co-operative Credit Society, Pattamangalam Village, Thiruchuli Taluk, Virudhunagar District based on the petitioner's representation dated 10.02.2021.

2.By consent of both sides, this Writ Petition itself is taken up for final disposal.

3.Heard Mr.B.Anandan, learned counsel appearing for the petitioner, Mr.A.Karthick, learned Government Advocate appearing for the first respondent and Mr.H.Arumugam, learned Standing Counsel appearing for the second respondent. In view of the order, we propose to pass in the Writ Petition, notice to the third respondent is dispensed with.

4.Learned counsel for the petitioner submitted that the third respondent, who is the President of T.Velangudi Village Panchayat is inimical towards the people who did not vote him. As a result, when the petitioner and others went to the temporary Paddy Procurement Centre located in his land, they were put to harassment. However, these controversies cannot be adjudicated in the Writ Petition. 5.Mr.H.Arumugam, learned Standing Counsel appearing for the second respondent on instructions submitted that for the current year, the paddy procurement is completed. Therefore, the prayer sought for has become infructuous.

6.In the light of the above, the second respondent Tamil Nadu Civil Supply Corporation, while locating the temporary Paddy Procurement Centre, shall ensure that it will be located in an uncontroversial place, preferably the land owned by the Government or it's Board or Corporation or Society, so that nobody has any grievance. We are not casting any aspersions on the fifth respondent, but this observation is made so that the public can freely go to the temporary Paddy Procurement Centre along with the produce without being subjected to any embarrassment.

7.The Writ Petition is disposed of with the above direction and observation. No costs.
