ORDER : The Court Made the following order :- On 20.01.2015, this Court has passed the following Order: "2.According to the prosecution, this petitioner was working as a teacher and he along with other accused had promised the defacto complainant that he will be appointed as a teacher in the school and they have collected Rs.7,50,000/- (Rupees seven lakhs and fifty thousand only) from the defacto complainant.

3.The learned counsel for the petitioner submits that the petitioner's wife has returned a sum of Rs.1,00,000/- (Rupees one lakh only) to the defacto complainant. It is seen that this petitioner had given an assurance on 18.03.2013 to the defacto complainant that he will undertake to pay a sum of Rs.4,00,000/- (Rupees four lakhs only) towards the money received from him. Even after that, the learned counsel for the petitioner submits that the said undertaking was obtained under coercion."

2.Even after that, the petitioner has not come forward to make any payment to the defacto complainant.

3.It is the case, where the defacto complainant was cheated by the petitioner. Hence, it is not a fit case for grant of anticipatory bail and the same is dismissed.
