Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 5 to take appropriate action against the sixth respondent and erring staffs of sixth respondent who had humiliated and insulted the children of the petitioner, within a time stipulated by this Court. ORDER
Heard both sides.
2.The petitioner's three children are studying in the sixth respondent School. I consciously refrain from going into the merits of the matter. Considering the special facts and circumstances of the case, this writ petition is disposed of with the following directions: a) The sixth respondent is directed to conduct special exams for the petitioner's three children since they omitted to take the term 2/4
examinations. This shall be done immediately. If the children clear the examinations, the School management shall issue Transfer Certificate, Promotion Certificate and Conduct Certificate. The School management has undertaken not to make any adverse entry. This course of action is agreeable to the writ petitioner also who has conveyed his consent through his counsel.
b) It is seen that the petitioner is in fee arrears. Technically the School management would be at liberty to institute proceedings for recovery of the said sum. Since the petitioner has agreed to take TC for his children, the School management is called upon not to pursue their claim regarding fee arrears.
3. This writ petition is disposed of accordingly. There shall be no order as to costs.
