O R D E R

The Criminal Original Petition has been filed to direct the second respondent to transfer the investigation in Crime No. 183 of 2019 on the file of the third respondent to the fourth respondent to any other agency or any other competent Officer.

2. Heard the learned counsel appearing for the petitioner and perused the materials available on record.

3. Today, when the matter is taken up for hearing, the learned Government Advocate (Cri. Side) appearing for the respondent police would submit that the investigation has been done in a proper manner, having found that the place of occurrence was not in the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No. 2949 of 2020 railway premises, the respondents have continued with investigation and they also tracked the accused one Thalavai Pandi and he was arrested and the JCB has been recovered from him. She would further submit that the investigation is going in a proper manner.

4. At this juncture, the learned counsel appearing for the petitioner prays that a direction may be issued to the superior officer to monitor the investigation done by the second respondent and a time frame may be fixed to file the final report.

5. In view of the aforesaid submissions, direction is issued to the Deputy Superintendent of Police, Maniyachi Division to monitor the investigation done by the third respondent. The third respondent shall conduct investigation, as expeditiously as possible, preferably, within a period of Three Months from the date of receipt of copy of the order. Registry is directed to mark a copy of the order to the Deputy Superintendent of Police, Maniyachi Division.

6. With the above observations, the Criminal Original Petition stands disposed of. Consequently, connected miscellaneous petition is closed.
