O R D E R
This criminal original petition is filed by the petitioner to direct the respondent police not to interfere with the civil dispute under the guise of enquiry.
2. According to the petitioner, there is a property dispute pending between the petitioner and the 3rd respondent. Originally, the property belongs to the petitioner and he mortgaged the property to the 3rd respondent and borrowed money and thereby, there is a dispute between the petitioner and the 3rd respondent. Already the 3rd respondent filed a suit in O.S.No.100 of 2019 before the District Munsif Court, Valliyoor and the same was withdrawn by them. While so, the 3rd respondent lodged a complaint before the 2nd respondent for the money dispute and taking advantage of the same, the 2nd respondent started to harass the petitioner. Therefore, he filed this petition.
3. The learned Additional Public Prosecutor (Criminal Side) appearing for the respondents no.1 and 2 would submit that already based on the complaint given by the 3rd respondent, they issued C.S.R.No.151 of Page No. 2 of 4
2025 and the same is under enquiry. They will complete the enquiry within one week. During the enquiry, they have not harassed the petitioner as alleged in the petition.
4. Considering the limited scope of the prayer of the petitioner and the 2nd respondent police is also conducting enquiry based on the complaint given by the 3rd respondent, this Court directs the 2nd respondent to complete the enquiry within one week from the date of this order.
5. With the above said direction, the Criminal Original Petition is disposed of. No costs.
