ORDER

This writ petition is filed to issue a Writ of Mandamus directing the 2nd respondent police to conduct enquiry on petitioner's representations/complaints dated 24.11.2011, or 31.12.2024.

2. The petitioner's husband is an ex-army man who has been missing since the year 2007. When the petitioner approached the Army authorities, they directed her to file a First Information Report and thereafter approach them for receiving pensionary benefits. However, the respondents refused to register the First Information Report, citing lack of jurisdiction and stating that the petitioner's husband was not traceable from Ambala. Under the BNS Act, the respondents are liable to register a First Information Report under the category of a Zero First Information Report.

3. Therefore, the respondents are directed to act upon the petitioner's representation in accordance with the provisions of the BNS Act.

4. With these directions, the impugned order is quashed and this Writ petition is allowed. No Costs.
